SUPPLY TERMS & CONDITIONS
These terms and conditions apply to the supply of any Products ordered from Aussie Time Clocks Pty Ltd or via a Website. By ordering or paying for any Products, you agree to be bound by these terms and conditions.
"Aussie Time Clocks Pty Ltd" or "ATC" means Aussie Time Clocks Pty Ltd ACN 163 959 779 trading as Aussie Time Sheets or uAttend Australia.
"Australian Consumer Law" means the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
"Consequential Loss" includes without limitation loss of profits, loss of revenue, loss of data, lost production, loss of business, loss of the benefit of any contract or other agreement or arrangement, losses which do not arise naturally from a breach of contract in the usual course, damage to reputation, damage to property, downtime costs and legal costs.
"Products" means any hardware, software or other goods or services offered for sale on a Website, or supplied by Aussie Time Clocks Pty Ltd.
- Express Warranty
ATC warrants only to the original Purchaser that the Products will be free from defects in material and workmanship for the warranty period stipulated in the purchase documentation (if any) ("Warranty Period") ("Express Warranty").
ATC’s sole obligation under the Express Warranty will be to repair or replace the Products during the Warranty Period. ATC does not assume any responsibility for delays for replacement or repair of Products. ATC may, at it’s sole discretion, replace hardware with refurbished hardware or parts.
The Express Warranty will be null and void in the following circumstances: 1. Modification or repair by the end user or any non-authorized ATC service provider; or 2. Improper use or installation, or damage by accident or neglect, by the end user or any third party, or intentional damage by the end user or any third party; or 3. Failure of the end user or any third party to exercise caution to protect from electrostatic discharge damage and adverse temperature, or physical abuse; or 4. Failure by the end user to follow the Return Appointment Process set forth below.
No salesperson, representative, or agent of ATC is authorized to make any guarantee, warranty, or representation that contradicts the terms contained in the Express Warranty.

The benefits given to consumers under the Express Warranty are in addition to other rights and remedies of consumers under a law in relation to goods or services to which the warranty relates. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
- Return Appointment Process.
As a condition precedent to the above Express Warranty, the end user must: 1. Obtain a Return Authority number ("RA") from ATC, which must be prominently displayed on the outside of the shipping container. Returns without an RA number may be rejected by ATC and immediately returned to end user, freight collect. 2. Ship the items being returned to ATC, freight prepaid, together with a written description of the claimed defect. 3. Pack the items being returned in the original packing carton or equivalent. Damage in transit is end user’s responsibility and may be cause to void the warranty claim. 4. Pay all transportation costs. The end user shall be liable for all costs of handling and transportation (to and from ATC).
- Limitation of Liability
ATC does not assume responsibility for any specific application to which any Products are applied including, but not limited to, compatibility with other equipment or software. All statements, technical information, or recommendations relating to the Products or parts are based upon tests believed to be reliable, but do not constitute a guarantee or warranty. If you purchase third party software or products to use in conjunction, connection or association with the Products for any reason, ATC will not be liable to you for any direct or indirect loss or damage that occurs to the Products or your computer system as a result of the use by You of that third party software or products.
Except for the Express Warranty, ATC makes no warranties or representations in relation to the Products or any information or advice provided by ATC. ATC excludes all implied conditions and warranties except any implied condition or warranty the exclusion of which would contravene any applicable law.
If the Australian Consumer Law or any other law implies a guarantee, condition or warranties into these terms and conditions which cannot be excluded by law, ATC's liability for any breach of such guarantee, condition or warranty will be, to the maximum extent permitted, limited to the replacement or supply of equivalent Products, or the payment of the cost of having the Product re-supplied.
ATC excludes all liability for any Consequential Loss however caused (including through negligence) which you may incur with respect to any Product or any information or advice provided by ATC.
ATC's maximum liability to you with respect to the Products is limited to the price you paid to ATC for the Products.
Nothing in these terms and conditions excludes any liability under the Australian Consumer Law, or any other applicable consumer law, that cannot be excluded by law.
- Returns Policy
ATC offers a 30 day return policy for change-of-mind orders. Refunds for change-of-mind are not available after 30 days from purchase. Products must be returned to ATC, at the purchaser's expense, and must be in original condition with no signs of damage. ATC must receive the Products within 30 days of the goods having been received by the customer. A 20% restocking fee applies to all change-of-mind orders. A refund of the purchase price, less the 20% restocking fee, will be made using the same payment method used at purchase. The refund will be made within 30 days of receiving the un-damaged, returned Products. Freight charges, setup and training labour, tech support labour and software licences are non-refundable. A Returns Authority number must be requested from ATC and used in all correspondence regarding the return.
All payments must be made in Australian Dollars (AUD) only.
